TERMS AND CONDITIONS OF USE FOR THE WESHARE PLATFORM

1. General Provisions / Purpose of the Platform

The WeShare platform (https://petrom.practici.ro) is a digital space created by OMV Petrom Marketing SRL (hereinafter referred to as "OPM"), intended for partners who manage OMV Petrom stations. The main purpose of the platform is to facilitate access to useful information, best practices, documents, and relevant resources for conducting commercial activities within the OMV Petrom station network. By using the platform, you agree to comply with these Terms and Conditions of use.

2. Usage Rights and Access Limitations

  1. Access to the platform is granted exclusively to authorized partners (content creators or viewers) by OPM, based on a user account created and approved (Authorized Users).
  2. Granting of usage rights and approval of content publication is carried out by the Platform Administrators/Moderators. The Platform Administrators/Moderators are OPM representatives. They are responsible for periodically updating the usage rights and content, as well as approving content for publication. Additionally, Platform Administrators may also upload content/documents of interest for all partners.
  3. Usage rights may include:
    • Viewing content;
    • Posting content and comments;
    • Downloading documents provided by OPM.
  4. It is prohibited to:
    • Publish irrelevant, defamatory, or offensive content;
    • Use another person's account;
    • Post materials containing special or sensitive personal data*;
      * According to Article 9 of the GDPR, the categories of sensitive data are those personal data that: reveal racial or ethnic origin, political opinions, religious confession or philosophical beliefs or trade union membership and the processing of genetic data, biometric data for the unique identification of a natural person, health data or data on the sex life or sexual orientation of a natural person. Personal data relating to criminal convictions and offences may also be included in the special categories of data (see Article 10 GDPR). In addition, in Romania, the concept of national identification number is defined - the number by which a natural person is identified in certain record systems and which has general applicability, such as: personal identification number (CNP), series and number of any identity document (passport, driver's license, social health insurance) is considered sensitive personal data.
    • Use the platform for advertising or personal purposes.

3. Responsibilities

3.1. Proposers (people who propose content to be published)

Content evaluation and approval process by the moderator on the WeShare platform:

  1. Submitting content for evaluation:
    • Partners or authorized users propose content (texts, images, files) via a dedicated form on the platform.
    • Each proposal must include: title, description, content category, purpose of communication, source of information and data processing agreements.

5. Audit and traceability

  • All stages of the process are recorded on the platform to ensure transparency and traceability.

3.2. Administrators

Administrator responsibilities after content approval:

Once a material is approved for publication on the WeShare platform, the administrator who approved it becomes responsible for the published content.

4. Platform Operation

  • The platform is accessible via the internet, 24/7, except during announced maintenance periods.
  • Content is organized into thematic categories (best practices, procedures, news, useful files, etc.).
  • Platform Administrators/Moderators have the right to edit, approve, or reject any content that content creators intend to publish, without prior notice.

5. General Applicable Rules

  • All interactions on the platform must be professional and respectful.
  • The following are prohibited:
    • Offensive language;
    • Discriminatory comments;
    • Publishing false or unverified information;
    • Sharing the personal data of other individuals without consent.

Thus, each content creator, BEFORE starting the activity that will be the subject of the post (not before creating the post content), must INFORM (using the Information Note – Annex 1) ALL individuals who will participate in the activity that their personal data will be processed for the purpose of publishing information about the activity.

The customized Information Note will be sent by email, together with the invitation to participate in the respective activity, to all those involved. It will also be printed (preferably in A3 format) and displayed as visibly as possible at/in the location of the activity.

Additionally, the Proposers must obtain, before creating the content to be published, the consent (as described in Annex 2) of ALL individuals appearing in the photo(s) or video(s) used in conjunction with the text of the post. The Information Note will be kept along with the other materials related to the activity (e.g., invitation, guest lists, participant lists, agenda, photos, printed consents – see Annex 2, etc.).

6. Technical Requirements

The platform is compatible with the following browsers: Google Chrome (latest 2 versions), Microsoft Edge, Mozilla Firefox.
A secure internet connection (HTTPS) is required. Enabling JavaScript and necessary and optional cookies is recommended for full functionality of the platform.

7. Intellectual Property

  1. All rights, titles, and interests in the materials available on the platform (texts, images, files, logos), including all related Intellectual Property Rights, are the property of OPM or the rightful owners.
  2. Reproduction, distribution, publication, or use of the content outside the platform is only permitted with the prior written consent of OPM.

8. Explicit Acceptance of Use

By accessing and using the platform, users explicitly accept the Terms and Conditions of use, including the Privacy Policy and the Cookie Policy.

9. Platform Security

  1. OPM implements technical and organizational measures to protect the platform and user data from unauthorized access, loss, or destruction.
  2. Users are responsible for the confidentiality of their login credentials (username, password).

10. Privacy Policy and Data Processing

The processing of personal data is governed by a separate Privacy Policy available on the platform. Personal Data is collected and processed in accordance with the applicable GDPR legislation.
The platform uses cookies for functionality, analysis, and user preferences.

12. Changes to this Document

OPM reserves the right to modify these Terms and Conditions at any time, with appropriate user notification. Continued use of the platform implies acceptance of the updated version.

13. Final Agreement Clause

By continuing to access the WeShare platform, you agree to the general terms and conditions of use of the platform as presented in this document.
